Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the website, dashboard, and API operated by Micah Latty (doing business as medicalfeeschedules.com) ("we", "us", or "our") (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

1. The Service

The Service provides computed, versioned Medicare Physician Fee Schedule (PFS) data — including RVUs, GPCIs, conversion factors, and calculated payment amounts — derived from files published by the Centers for Medicare & Medicaid Services (CMS), via public web pages, a dashboard, and a REST API.

Micah Latty (doing business as medicalfeeschedules.com) is an independent service. We are not affiliated with, endorsed by, or sponsored by CMS, the U.S. Department of Health and Human Services, or any government agency.

2. No professional advice; informational use only

The Service provides data and calculations for general informational purposes only. It does not constitute medical, legal, billing, coding, financial, or reimbursement advice, and it is not a substitute for the official fee schedules, rules, and guidance published by CMS or your Medicare Administrative Contractor (MAC). Calculated amounts are estimates of national and locality-adjusted rates under the published PFS formula; the amount actually payable on any specific claim depends on factors outside the Service (including modifiers, MPPR and other payment adjustments, coverage and medical-necessity rules, patient eligibility, and MAC-specific policies). Nothing in the Service is a guarantee of payment, coverage, or reimbursement. You are solely responsible for verifying any figure against official CMS sources before relying on it for claim submission, appeals, contracting, or any other consequential decision.

3. Data accuracy

We work hard to ingest CMS releases faithfully and to compute rates correctly, and every API response identifies the release (year and quarter) that produced it. Nevertheless, source files may contain errors, CMS may correct or republish releases, and our ingestion or computation may contain defects or lag CMS updates. The data is provided without any warranty of accuracy, completeness, or timeliness. If you find a discrepancy, please report it to us.

4. Protected health information

You must not submit protected health information (PHI) or other patient-identifying information to the Service — in API requests, calculator inputs, uploads, or support communications. The Service only requires procedure codes, localities, dates, settings, and dollar amounts. We are not a HIPAA covered entity or business associate, we do not sign Business Associate Agreements, and the Service is not designed or offered for the storage or transmission of PHI. Any PHI submitted in violation of this section may be deleted without notice, and you are solely responsible for the consequences of submitting it.

The underlying fee-schedule data published by CMS is in the public domain. The Service — including its software, design, documentation, compilations, computed outputs, and presentation — is owned by Micah Latty (doing business as medicalfeeschedules.com) or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and the data you retrieve through it.

CPT® is a registered trademark of the American Medical Association (AMA). CPT code descriptors are copyrighted by the AMA and are not made available on public or unauthenticated surfaces of the Service. You are responsible for obtaining any license you may need from the AMA for your own use of CPT content.

If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or obligation to you.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access (in whole or in part) if you materially breach these Terms, if your usage threatens the security, integrity, or availability of the Service, if required by law, or for non-payment. Where practicable, we will give you notice and an opportunity to cure before terminating. Upon termination, your right to use the Service ends and your API tokens are revoked; sections of these Terms that by their nature should survive (including Sections 2, 3, 7, and 10–13) survive termination.

THE SERVICE AND ALL DATA PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICAH LATTY (DOING BUSINESS AS MEDICALFEESCHEDULES.COM) AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL — INCLUDING WITHOUT LIMITATION ANY DAMAGES ARISING FROM DENIED, REDUCED, OR DELAYED CLAIMS OR REIMBURSEMENT — ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You will defend, indemnify, and hold harmless Micah Latty (doing business as medicalfeeschedules.com) and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Service in violation of these Terms or applicable law, (b) content or data you submit to the Service (including any PHI submitted in violation of Section 4), or (c) your products, services, or claims-related decisions that rely on data obtained through the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Illinois, and you consent to their jurisdiction and venue. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

14. Changes to the Service and these Terms

We may modify the Service over time, including adding, changing, or removing features. We may also update these Terms; if we do, we will post the updated Terms on this page and revise the "Last updated" date above, and for material changes we will provide additional notice (such as email to account holders) at least 14 days before the change takes effect. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms; if you do not agree, stop using the Service and cancel your account.

15. General

These Terms, together with the Privacy Policy and any plan-specific terms you agree to, are the entire agreement between you and Micah Latty (doing business as medicalfeeschedules.com) regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays or failures caused by events beyond its reasonable control.
